The general terms and conditions of sale described below govern all contractual relationships, to the exclusion of all other conditions, between:

CordesExpress, an online store operated by MPROSHOP, which sells musical instruments and accessories online through its website www.cordesexpress.com, and customers wishing to use the service provided by MPROSHOP to make online purchases.

Both customers and MPROSHOP adhere to these terms without reservation.

Customers declare that they have read the following provisions before ordering products and expressly accept these general terms and conditions of sale by clicking the acceptance button provided for this purpose during each order.

By choosing to purchase the products, the customer expressly and irrevocably accepts the terms set forth below.

The applicable regulations for the sale are those of distance selling currently in force in France, which MPROSHOP recalls below to the customer.

The photos and descriptions of the products presented on the website www.cordesexpress.com or www.cordesexpress.fr are not contractually binding.

Finally, the services offered by MPROSHOP are reserved for persons legally capable of entering into contracts under French law.

The customer therefore declares that they have the capacity to enter into this contract, i.e., they are of legal age and are not under guardianship, curatorship, or judicial protection.

1. Orders

1.1. Order Registration:

After choosing the product(s) they wish to order on the CordesExpress website, the customer must identify themselves using the electronic form provided for this purpose. Once the order is validated by the customer, MPROSHOP confirms the registration of the order by email. A unique order number is assigned to the customer.

The mere issuance of this number does not constitute acceptance of the order, which is only confirmed after actual payment of the order and subject to product availability, as specified in Article 4 of these general terms and conditions of sale.

1.2. Order Confirmation:

The order placed with MPROSHOP becomes final only after the effective payment of the order by the customer using any of the payment methods provided in these general terms and conditions of sale. Otherwise, the order is considered null and void, and MPROSHOP will notify the customer by email. Upon receipt of the effective payment, MPROSHOP will send a new email to the customer to confirm the order and proceed with the shipment of the ordered products.

MPROSHOP reserves the right to cancel or refuse any order from a customer with whom there is a dispute over payment of a previous order.

2. Price

2.1. Price of the Ordered Product:

The prices of MPROSHOP products are indicated in euros, all taxes included, excluding participation in processing and shipping costs. MPROSHOP reserves the right to modify the prices of the products at any time, but the products will be invoiced based on the rates in effect at the time the orders are registered. Any change in VAT will automatically be reflected in the product price.

2.2. Shipping Costs:

A flat shipping fee is calculated in your shopping cart after you register your delivery address.

3. Products

The characteristics of the products offered for sale and the associated photographs are not part of the contractual field. MPROSHOP cannot be held liable if errors occur.

4. Product Availability

The products sold by MPROSHOP, and manufactured by a third-party supplier, are offered for sale, subject to availability at the supplier. MPROSHOP undertakes to inform the customer by email within 5 days (excluding weekends and holidays) from the registration of the order of any difficulty related to the unavailability of a product.

5. Payment

Payment for orders can be made by credit card, check, bank transfer, or PayPal. Payment by credit card is made on a secure server. MPROSHOP reserves the right to suspend any order and delivery in the event of refusal of payment authorization by officially accredited organizations or in the event of non-payment. MPROSHOP also reserves the right to refuse to make a delivery or to honor an order from a customer who has not fully paid for a previous order or with whom a payment dispute is being managed.

6. Delivery

Delivery is made to the address specified by the customer when placing the order. The customer must ensure the accuracy of the information provided. In the event of a delivery error due to an incorrect address provided by the customer, MPROSHOP cannot be held responsible, and the customer will be responsible for the shipping costs for resending the package. Delivery times are given as an indication and are not guaranteed. Any delays do not entitle the customer to cancel the sale, refuse the goods, or claim damages.

7. Right of Withdrawal

In accordance with Article L121-16 of the Consumer Code, the customer has a period of 14 days from the date of receipt of the order to exercise their right of withdrawal and return the product(s) ordered. Returns must be made in their original condition and packaging. If this condition is not met, the return will be refused by MPROSHOP. The return costs are the responsibility of the customer.

8. Warranty

Products benefit from the legal warranty against hidden defects provided by articles 1641 and following of the Civil Code. In case of a hidden defect, the customer must return the product(s) concerned in their original condition and packaging.

9. Liability

MPROSHOP cannot be held liable in case of non-performance or improper performance of the contract due to the customer, an unforeseeable and insurmountable act of a third party to the contract, or in the event of force majeure.

10. Intellectual Property

All texts, comments, works, illustrations, and images reproduced on the CordesExpress site are reserved under copyright and intellectual property law for the whole world. As such, and in accordance with the provisions of the Intellectual Property Code, only private use is allowed, subject to different, even more restrictive provisions of the Intellectual Property Code. Any total or partial reproduction of the CordesExpress site is strictly prohibited.

11. Personal Data

In accordance with the Data Protection Act of January 6, 1978, the customer has the right to access, modify, rectify, and delete personal data concerning them. To do this, the customer must make a request via email or by post.

12. Dispute Resolution

These general terms and conditions of sale are subject to French law. In the event of a dispute, jurisdiction is attributed to the competent courts of La Rochelle, notwithstanding multiple defendants or warranty claims.

13. Modification of the General Terms and Conditions of Sale

MPROSHOP reserves the right to modify these general terms and conditions of sale at any time. The new terms and conditions will apply to orders placed after their online publication.
